WILL, SHARIAH WILLS AND LAST TESTIMONY

A Will or Faraidh is a legal document declaring an individuals wish about their assets distribution after their death.

The UAE is a muslim country and the legal system applies the sharia with regards to inheritance and this is applicable only to muslim expatriates and UAE Nationals. Due to the diverse UAE community the courts accept Wills of any individual irrelevant of their faith residing in the Emirates providing they have permanent residence.

Once a Will is drafted it needs to be legalised by a local court. In the case of expatriates the Will needs to be attested by an authority of their home country and then legalised.

For non-muslim expatriates that do not have a Will in place it can cause confusion should the unforeseen occur. For muslim expatriates that have not legalised a Will, sharia law is applied thus first outstanding debts are settled before disbursement of assets.

The laws of inheritance are completly based on the Quran and the Sunna. Shariah is not a conventional codified law and is flexible and open to further translation.
